OpsMind Technologies Ltd · Effective 3 October 2026
Terms of Service
These Terms govern your use of the OpsMind platform (the "Service"), provided by OpsMind Technologies Ltd, company number 16946193, registered office 5th Floor, 167–169 Great Portland Street, London W1W 5PF, United Kingdom ("OpsMind"). You accept them, together with our Acceptable Use Policy, our Privacy Policy and our Data Processing Agreement, by ticking the box when you create an account or first sign in. We record which version you accepted and when. A signed order form with OpsMind takes precedence over these Terms where the two differ.
1. Account & eligibility
You must be 18 or over and have authority to bind the organisation you register for. You are responsible for keeping your sign-in details safe and for all activity under your account.
2. Plans, billing & trials
- Trial: a free trial is a one-time credit of US$10, valid for 30 days, with one agent. Usage is drawn from the credit at the rates shown in the app. The trial ends when the credit is used up or expires. We may end a trial that looks abusive or not genuine.
- Paid plans: paid plans renew automatically until cancelled. Fees are charged through Stripe and are non-refundable except where the law requires otherwise.
- Included minutes: each plan includes a set number of voice minutes. Voice stops at the plan's limit; we do not bill usage above it.
- Unpaid accounts: if a payment stays unpaid for more than 7 days, the service is paused until it is paid.
3. Acceptable use
Your use must follow the Acceptable Use Policy. In particular, you will not, and will not let your end users:
- call or message people without a lawful basis or against do-not-call rules (TPS, DNC or the local equivalent);
- harass, defraud or impersonate anyone;
- run political robocalls or unsolicited mass marketing without express opt-in;
- try to extract our prompts, configuration or source code;
- resell the Service without a written reseller agreement.
You are responsible for telling the people your agents speak to what the law requires, including that they are speaking to an automated agent and, where calls are recorded, that they are. We may suspend access without notice if we reasonably believe use breaks this section or the law.
4. Customer content
You keep all rights in the content you upload or generate: knowledge sources, prompts, recordings, transcripts and contact data. You grant OpsMind a worldwide, non-exclusive licence to process it only to provide the Service. We do not use your voice or text data to train AI models without your separate written consent. To test changes before release, we keep a small set of past transcripts with phone numbers removed and no audio.
5. Availability
We do not commit to an availability level and do not offer service credits. The Service runs on a single server without a standby, and depends on other providers, including Google and the phone carriers. The status page shows the health of the database, queue and background worker.
6. Confidentiality
Each party will protect the other's confidential information with the same care it uses for its own, and at minimum reasonable care. Customer usage data, prompts and workspace configurations are confidential.
7. Warranty & disclaimer
The Service is provided "as is". OpsMind does not warrant that AI outputs will be free of errors. You are responsible for human review of AI-generated content before any irreversible action.
8. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss. Aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, wilful misconduct, or anything that cannot be excluded by law.
9. Termination
Either party may terminate for a material breach left uncured 30 days after notice. You can close your workspace by writing to hello@opsmind-tech.com. Within 30 days of a written request, our team will export your data in a machine-readable format and then delete it, including call recordings, from the live system. Backup copies expire within about 2 months.
10. Changes
When we change these Terms, the AUP or the Privacy Policy, we update the effective date and ask account holders to accept the new version when they next sign in.
11. Governing law
These Terms are governed by the laws of England & Wales. The courts of London have exclusive jurisdiction, except where mandatory local law gives you the right to bring proceedings where you are.
